Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Agimon Pty Ltd (“Agimon”, “we”, “us” or “our”) for the Oinky app, website and related services (“Oinky”). By creating an account, purchasing a subscription or using Oinky, you agree to these Terms and our Privacy Policy.

A parent or carer must be at least 18 years old and legally able to enter this agreement. The adult creates and controls the family, must have authority to add each child, and is responsible for the child’s supervised use. A child may use Oinky only within a family set up by an authorised adult.

Oinky is currently free for every family. While it is free, no membership or payment is needed and no purchases are offered in the app. If paid memberships return, the terms in this section apply and we will tell you in the app before anything changes.

Oinky offers one paid membership for the whole family. Available plans are displayed in the app before purchase, currently including a weekly plan and an annual plan. The price does not change based on how many family members, chores or virtual coins the family creates or uses.

New families get 1 month free. Depending on how it is started in the app, the free month either needs no App Store subscription and simply ends, or is an App Store free trial that renews at the price shown by Apple unless you cancel at least 24 hours before the trial ends. The exact localized price and billing period shown by Apple at checkout control. If we introduce a promotional offer later, the eligibility, duration and price displayed by Apple will apply.

Subscriptions are processed by Apple, charged to your Apple account, and automatically renew for the same period unless cancelled at least 24 hours before the current period ends. Apple may charge the renewal within 24 hours before expiry. Manage or cancel in your Apple account subscription settings. Deleting Oinky does not cancel a subscription.

Refund requests are handled under Apple’s process and applicable law. Nothing in these Terms excludes consumer guarantees or remedies that cannot lawfully be excluded, including under the Australian Consumer Law.

Oinky coins are an in-app family accounting tool. Parents choose how many coins a chore earns, how many coins a reward costs and how many coins the family creates. Coins are not purchased from us.

Coins have no cash or monetary value, cannot be sold, transferred outside the family, redeemed from Agimon or exchanged for legal tender. The parent, not Agimon, creates, approves and fulfils each family reward. Oinky records the family’s choices but does not guarantee that a parent will provide a promised reward.

Parents are solely responsible for choosing chores that are safe, lawful and appropriate for the child’s age, abilities, health, location and supervision. Do not assign dangerous work, hazardous substances, unsafe tools, driving, unsupervised cooking or any activity requiring professional training unless an appropriately qualified adult has made it safe and directly supervises it.

Photo, before-and-after or video proof is a family aid, not a safety inspection. On-device automated assessments can be wrong. Parents remain responsible for reviewing completions, discussing mistakes fairly and never using Oinky as the only basis for discipline, withholding essentials or making a decision affecting a child’s safety or wellbeing.

Do not capture intimate, humiliating or unlawful material, other people without permission, private documents, precise location details or anything the family does not need to assess the chore.

Oinky Focus uses Apple Screen Time frameworks and device permissions to apply settings chosen by a parent. Operating-system limits, revoked permissions, offline devices, delays, bugs or device changes can prevent or delay enforcement. Some authorization modes can be changed by the child in device settings.

Oinky is not parental-surveillance software, emergency software or a substitute for supervision, family discussion, professional advice or device-level safety controls. Never rely on Oinky to prevent access to emergency calling, health, education or other essential services.

We work to keep Oinky available and accurate, but features may change and interruptions can occur. To the extent permitted by law, Oinky is provided “as is” and “as available” without a promise that it will always be uninterrupted, secure or error-free.

You must not misuse Oinky, including by:

• breaking law, infringing rights, harming a child or impersonating another person;
• uploading malware or attempting to bypass security, subscription or family controls;
• scraping, probing, overloading or interfering with Oinky or another family’s account;
• reverse engineering or copying Oinky except where applicable law expressly permits it; or
• using Oinky commercially, reselling access or transferring an account without our permission.

Agimon and its licensors own Oinky, including its software, design, branding and content. We grant you a personal, limited, revocable, non-exclusive and non-transferable licence to use Oinky on Apple-branded products you own or control, subject to these Terms and Apple’s Usage Rules.

You retain rights in information you enter. You give us the limited rights needed to host, process and transmit it to provide and protect Oinky. Feedback may be used without restriction or payment, provided we do not publicly identify you without permission.

You may stop using Oinky or delete the family account at any time, but must separately cancel an Apple subscription. We may restrict or suspend access where reasonably necessary to protect a child, users or the service; investigate fraud or security issues; comply with law; or address a material breach of these Terms. Where practical, we will give notice and a chance to resolve the issue.

To the maximum extent permitted by law, Agimon is not liable for indirect, incidental, special or consequential loss, loss of data, lost opportunity, or a family member’s failure to provide a reward. Any liability that cannot be excluded is limited only to the extent the law permits. These limitations do not exclude liability, guarantees or remedies that cannot legally be excluded.

These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have non-exclusive jurisdiction, subject to any mandatory consumer right to bring a claim elsewhere. Before filing a claim, please contact us so we can try to resolve it.

These Terms are between you and Agimon, not Apple. Agimon, not Apple, is responsible for Oinky, support, product claims and addressing any claim that Oinky infringes third-party intellectual property. Apple has no obligation to provide maintenance or support.

Your use must comply with applicable third-party terms, including Apple Media Services terms. If Oinky fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price as required by its terms; to the maximum extent permitted by law, Apple has no other warranty obligation for Oinky.

You represent that you are not in a country subject to a United States government embargo or designated as supporting terrorism, and are not on a United States government prohibited or restricted-party list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce this section against you.

We may update these Terms as Oinky or the law changes. We will post the updated Terms, revise the effective date and provide additional notice where required. If a material change applies to an existing paid period, it will not remove mandatory rights or reduce paid access without an appropriate remedy.
